'You cannot pick, choose and hang,' Govt says on Afzal case

Government on Friday said the execution of death sentence of Afzal Guru, convicted in the Parliament attack case, was being delayed as "you cannot pick, choose and hang" and there were many mercy petitions pending for long.

"You cannot pick, choose and hang. Nowhere does it happen in the world including Pakistan," Law and Justice Minister M Veerappa Moily told a 'meet the press' programme organised by Press Association here.

Noting that no country which has rule of law can have such a hanging carried out "at the discretion of any political party", Moily said there was need for evolving a mechanism for quick disposal of mercy petitions.

He said 28 mercy petitions were pending for disposal for long.

the govt of india is extreme cases can pull out a offender and hang him if required. im sure there must be a provision. this man is the enemy of the nation and kasab, so how can the govt not make these cases an example so that other terrorist take a leaf out of this. with the delay its justice denied. for what appeasement of one community for the safety of the nation.

Sure you cannot 'pick. choose and hang" according to Veerappa Moily at the Meet the Press in reference to Afzal Guru's execution. But one can hasten the disposal of the mercy petitions. First does Afzal Guru's case qualify for mercy petitions. Which means all terrorists can also seek the same. After all the longer the pendancy period the great the agony for the convicts and greater the finanacial expenditure. When today every thing is put on a fast track why this undue delay.

To be effective, justice needs to be swift and uniform.

Dear Mr. Minister,
It is not a question of simple pick choose and hang but the lethargy of the law in our country to bring the culprits to justice. And the lawmakers like you take pride in implementing the judgements. In this particular case the government must send a clear message to the perpetrators of terrorists by expediting this. On the contrary you and your government is sleeping on this and delaying the justice to those who sacrificed their precious lives.

Our justice system needs to be reviewed to make it transparent in regard to inordinate delays in carrying out the decision of the highest court of law of the land including the Mercy Petition. Otherwise it creates doubts and anguish in minds of people just as it is happending in case Afzal Guru. Afzal guru has been found guilty of the highest crime against the country.

Is the sentence confirmed by the Hon`ble Supreme Court to be carried out or not at "the discretion of any political party? What discretion are we left with after the repeated decisions of the court? Who is responsible for keeping the Mercy petition salted and pickled all these years? And now comes a Daniel for judgement
