No discission yet to drop Justice Dinakaran

The uncertainty over the elevation of Karnataka Chief Justice PD Dinakaran to the Supreme Court prevailed on Sunday with the Chief Justice of India stating that a decision in this regard is yet to be taken.

Speaking to The Pioneer at the sidelines of the All-India conference of Central Administrative Tribunal, CJI KG Balakrishnan said, “We have not taken any decision yet.” He was responding to a query whether the Collegium of the Supreme Court was considering dropping the name of Justice Dinakaran for elevation to Apex Court.

Maintaining the stand that the Collegium has not decided on dropping the name of Justice Dinakaran, CJI conceded that at present the name of Justice Dinakaran has been “de-linked” from the remaining four names recommended for elevation to the Supreme Court. “We have asked the names of four judges to be processed for appointment,” CJI said.

The Collegium, which met last week discussed the issue and deferred its decision in the light of Justice Dinakaran’s consistent denial of the allegations of corruption and public encroachment of land leveled against him. Though a discreet enquiry conducted by the Tiruvallur District Collector found him guilty of encroaching 197 acres of public land, the Collegium thought it appropriate to seek more details from the state government to ascertain additional facts.

Union Law Minister M Veerappa Moily, who was also present at the event shied away from disclosing any facts on the current controversy. When asked whether he had received any communication from the CJI to drop the recommendation of Justice Dinakaran, Moily said, “there are several communications I exchange with several constitutional authorities. I do not intend to comment on the same.” To a pointed query whether it was the end of the road for Justice Dinakaran, Moily said, “It is for them to decide,” referring to the Supreme Court.
