2G: Swamy moves SC against trial court order on Chidambaram

Janata Party chief Subramanian Swamy today moved the Supreme Court challenging the trial court order which had held that Home Minister P Chidmbaram did not indulge in any criminal conspiracy in the 2G case and refused to make him an accused in it.

Swamy has alleged that Chidambaram was equally culpable like former Telecom Minister A Raja as he also had a role in deciding the spectrum pricing and allowing telecom companies to off-load shares to foreign firms.

He had said that the evidence brought before the trial court was sufficient to show that Chidambaram, as the then finance minister, had prima facie committed offences under the Prevention of Corruption Act and other criminal laws.

Swamy's plea was, however, rejected on February 4, by the Special CBI Court, trying the 2G case, which had said Chidambaram did not indulge in any criminal conspiracy or derived any pecuniary advantage in the decisions taken with Raja.

The trail court had said that Chidambaram, the Finance Minister at the time of controversial allocation of 2G spectrum in 2008, was only party to two decisions--keeping spectrum prices at 2001 level and dilution of equity by two companies--which was "not per se criminal".

The Supreme Court had on February 2 left on the special court to decide the plea to try Chidambaram in the case.

The trial court had rejected the private criminal complaint filed by Swamy, saying it was without merits.

It said Swamy could not bring evidence on record to show that Chidambaram was acting with "corrupt" and "illegal" motive and the case against him was distinguishable from other accused who are facing trial in the 2G case.

Instead of us wishing Dr.Swamy good luck,it would be wonderful if we could learn the methods by which he has been able to argue so many important cases effectively.It does not mean that we should follow him blindly,but the crispness and clarity of his thought and the complexities of his undertakings,ce rtainly are worth observing keenly and learning from actively.In fact instead of flying in foreigners to various business schools etc.,it would be wonderful if Dr. Swamy could conduct masterclasses on a variety of subjects.At the same time,he has also said that he would have been able to argue more cases if he has more assistance,well ,the people who benefit from his masterclasses could help act as force multipliers.

All national loving people have pinned their last hopes on Dr. Subramaniam Swamy and hope that he succeeds in convincing the SC of Mr.PC's complicity in the case.
Though the evidences are overwhelmingly against Mr.PC, the odds are stacked against Dr.Swamy, the crusader against corruption and family rule, as most of the investigating agencies are either directly under HM or under PM & both, by hook or crook, will try & ensure these agencies like many of out institutions dance to the tune of Congress and its leader & no truth ever comes out of them. For the nation's bad luck, they continue to be masters in circumventing the truth and issues!

We wish Dr Swami gets success in getting justice for this great Nation.But it is really difficult as the matter is against PC.As almost all the agencies are polluted by UPA Govt and there is a deliberate attempt of marginalizing/polluting remaining ones also.This is clear from draconian laws being brought-in mainly to harass majority community.It will be a wonder if the case related to election gotala by PC comes up at all before 2014.In this land it is difficult to get justice unless belonging to a minority community.PC is there to help out and can be rewarded.

this guy needs our support against the corruption are is there in our country. irrespective of whether you support him on other issues but i think this fight needs to be won. then can we progress as a nation. why should we keep paying all the taxes and let the congress loot therm along with their allies. we have to put pressure on the legal system that they are not to be effected by political pressure or after retirment postings
