First FIR filed under Aadhaar Act after two found having same biometric info

The Delhi Police has registered the first case under the Aadhaar Act following Unique Identification Authority of India’s (UIDAI) complaint that two persons were found having the same parameters of biometric information.

The persons have been identified as Raj Kishore Roy and Debayan Roy. Previously Skoch Group chairman Sameer Kochchar was booked for spreading false rumours on Aadhaar, but the FIR was registered under IT Act.

Deputy Commissioner of Police, Crime Branch, Bhishm Singh, under whose supervision the case is being probed, confirmed the case and said that it is the first case registered in India under the Aadhaar Act.

The FIR has been lodged at Crime Branch police station. “We are investigating the matter. The accused in the case have been served notices,” DCP Singh told The Pioneer.

In his complaint, Deputy Director in Pragati Maidan UIDAI regional office Ramesh Kumar stated, “On March 13 this year a person named Raj Kishore Roy, who is a resident  of Shashtri Bhawan in East Delhi’s New Ashok Nagar, Vasundhara Enclave had  enrolled for Aadhaar under EID (Enrollment ID) 20791680400745 by submitting his demographic and biometric information.”

However, upon UIDAI’s internal scrutiny, it was found that a few days before on March 17, another person named Debayan Roy, a resident of Noida sector 16A in Network 18, Express Trade Tower, had already enrolled for Aadhaar under EID 14099657144574 by using the same biometric and demographic information as that of Raj Kishore Roy, he added.

“The incidents, prima facie, imply that a single person with the same parameters of biometric information has got himself enrolled under two different identities thereby impersonating in either or both the incidents presumably using fabricated documents. It is a violation of the provisions of the Aadhaar Act and certain sections of the Indian Penal Code,” said Kumar.

DCP Singh further said that the case has been registered under section 34 and 35 of the Aadhaar (Targeted delivery of financial and other subsidies, benefits and services) Act and Aections 419 (Punishment for cheating by impersonation) and 34 (acts done by several persons in furtherance of common intention) of the Indian Penal Code.

UIDAI is an agency of the central Government of India. The UIDAI was conceived with an intention to assign a clear and unique identity number for each resident across the country which would be used primarily as the basis for efficient delivery of welfare services. Pursuant to such objective, UIDAI collects the biometric and demographic data of the residents of India, stores them in a centralized database and issues a unique identity number called Aadhaar to each of them.
