CAIT seeks dissolution of SC’s sealing panel in city

Monday, 15 July 2019 | Staff Reporter | NEW DELHI

The Confederation of All India Trade (CAIT) has demanded that the Supreme Court appointed Monitoring Committee should be dissolved immediately as all of   its member are above the age of 70 years.

Keeping in consideration of the retirement age in Government and Supreme Court, the Committee should be dissolved, the traders’ body said.

CAIT Secretary General Praveen Khandelwal said that the pertinent question arises as to why the Government has set retirement age. “Because it is presumed that after attaining the retirement age, the capillaries of the body do not work so effectively and efficiently and smooth working is not expected from a person who has attained retirement age.

He further said that even the judges of Supreme Court retire at the age of 65 years, therefore, at least the same retirement age should also be applicable on not only on members of Monitoring Committee but to all panels set up by Supreme Court from time to time for different issues.

Khandelwal said that the CAIT is consulting its lawyers and may move  the Supreme Court to decide this issue that retirement age should be applicable on any Committee or panel the Supreme Court set up for its help. The CAIT will also write to Government for framing laws for such type of Committees or panels, he added.

“Perhaps at the time when Monitoring Committee was constituted in year 2006, the members of Monitoring Committee might be below the retirement age but now since they have crossed retirement age, the Monitoring Committee should be dismantled,” he said, adding that after all there has to be some criteria for setting up of such Committees since they are considered as extended arm of Supreme Court.
