Tytler booked for usurping plots

The Delhi Police has registered First Information Report (FIR) against former Union Minister Jagdish Tytler for allegedly cheating and criminal breach of trust. Police said that the complainant stated that Tytler and 10 other persons had illegally usurped two plots in Delhi’s Karol Bagh area.

According to FIR registered with Economic Offense Wing (EOW) of Delhi Police, the complainants Vijay and Anil Sekhri, who owns 25 per cent share in Gautam Overseas limited (GOL) said that two plots (assets) own by the company said that the plots, which value around 271 crores, were given on rent by forging documents with intention of defrauding and remove real owners of the plots from their rights. The complainant said that the plots in 2007, were given on lease and they were unaware about it.

According to complainant, the plots were purchased by Jagdish Tytler and Sekhri Family through GOL and both Tytler and Sekhri family that time held 50 per cent share each in the company. Shekri family’s share was divided between the complainants and their elder brother Bhupinder Sekhri equally  at 25 per cent each ratio.

“In order to protect the interest of Sekhri family and Tytler, it was agreed that Sekhri family will have the control over GOL’s records along with the original documents of the plots. The papers were kept with Bhupinder till the work is initiated on the plots and physical control and possession of the plots were under Jagdish Tytler on a good faith and trust,” said the FIR.

“In 2009, the family got divided and Bhupinder Shekri’s shares were illegally bought by Tytler through his two companies, which were later merged into Sun Real Estate Pvt Ltd, making him 75 per cent of share holder in GOL,” said the complainant.

“Over  a period of time,  Tytler developed a mala fide intention to illegally usurp the share and interest of the complainants in the plots through his dummies companies. Tytler conspired with the help of  Bhupinder  Sekhri and took original documents of the plots from the registered company’s office, without any knowledge of the complainants, who were having 25 percent in the GOL,” stated FIR.

 “The complainants approached Supreme Court in 2017, which ordered valuation of the two plots at a fair market value, under supervision of Justice Mukud Mudgal. The valuation was calculated to the amount of Rs 271 crores and according to share holding of 25 percent, the complainants have rightful share of Rs 67 crores in the only two plots  owned by GOL,” said the complainant.

“After valuation by Apex court, Sun Real Estate Pvt Ltd, indirectly owned by Tytler, which said to buy the 25 per cent share of the Sekhri brothers back out following which the court directed to auction the properties. A order to vacate the plots were also issued but Tytler company backed down and said that they have no relation with the companies on plot and cannot get the two plots vacated,” said the complainant.

The complainant said that in the records of North Delhi Municipal Corporation, the land use of the plot acquired by J D Tytler learning Centre is shown as ‘Banquet Hall’ and the occupancy is shown as “Self occupied” whereas it remains a question how was the plot converted by all the accused persons when GOL never carried out any change is land status. “How it is being used as banquet hall when it is in possession of the JD learning Centre”,  the complainants alleged.   

Meanwhile, a senior police official said that in preliminary investigation suggests no involvement of Jadgish Tytler in the complaint. However, Jagdish Tytler, talking to The Pioneer said that he have no links with the companies. “The school is running there since 1954 and I am tenant there. I have no role and I own no company alleged in the FIR. There is dispute between Sekhri brothers and they are dragging me into it without any reason,” said Tytler.
