Conduct fresh cadre review of all CAPFs by June ’21: HC

Disposing off a petition challenging the IPS deputation into the Central paramilitary forces till the rank of Inspector General, the Delhi High Court on Monday directed the Centre to conduct a fresh cadre review of all forces by June 2021.

The court also directed the Centre to review the Recruitment Rules of the paramiliatry forces and the cadre officer will get in opportunity to represent in the cadre review exercise and for framing of new Service Rules on the line of Organised Group 'A' Service.

The Court while disposing the pleas said that even if IPS Officers are occupying any posts in the paramilitary or Central Armed Police Forces (CAPFs), grant of opportunity of hearing to them is not the same as grant of opportunity to the Cadre Officers of CAPFs. It is only the Cadre Officers of CAPFs who have grievances qua stagnation, residency etc. and the IPS Officers, even if manning some posts in CAPFs, are not aggrieved therefrom. 

The court disposed the matter by directing that the members of each CAPF to make comprehensive representation (s) to the Ministry of Home Affairs, for amendment of the respective Recruitment Rules of each Central Armed Police Force including cadre structure, residency and Deputation.

It also directed the government to immediately undertake the exercise for review of existing Recruitment Rules of each Central Armed Police Force taking into consideration the representation(s), if any, received from the members of the Central Armed Police Forces and after giving them an opportunity of being heard and to place its decision in this regard before the Department of Personnel and Training.

The court directed the Department of Personnel and Training to take necessary action immediately on receipt of decision from the Ministry of Home Affairs with respect to review of Recruitment Rules of respective CAPF.

The court directed the DoPT that the entire exercise OF cadre review be concluded on or before June 30, 2021.

The court also vacated the stay on promotions to the post of DIG/IG in the CAPFs. The order was passed by the bench of Justice Rajiv Sahai Endlaw and Justice Asha Menon.
