'Model Code of Conduct in force for Mandar Bypoll'

The Election Commission of India has announced the 66-Mandar (ST) Legislative Assembly bye-election 2022. The Model Code of Conduct is effective from the date of announcement.

During this period, various political parties and candidates will organize public meetings, processions for election campaign. Due to political rivalry and competition in public meetings and processions, there is a strong possibility of influencing, intimidating the voters by displaying arms and power and breaking the law and order. Apart from this, law and order problems can arise due to the active use of unwanted and anti-social elements to intimidate, threaten voters, spread the feeling of caste, communal and religious hatred, due to which public peace can be disturbed.

In order to maintain a healthy and peaceful environment for fair bye-elections, till the end of the election process or up to a maximum of 60 days, whichever is earlier, the Sub-Divisional Officer Ranchi Sadar has issued prohibitory orders in the entire 66-Mandar (ST) Vidhan Sabha constituency under the sub-division has been given. This prohibitory order is in force from the forenoon of 26 May 2022.

No person, political party, organization or candidate will organize any kind of meeting, procession, dharna or any kind of demonstration related to political purpose without prior permission of the competent authority. In the procession, any person is prohibited from carrying any kind of sharp weapon (shastra and weapons) which is fatal to the human body.

Under the Control of the Use and Play of Loudspeakers Act 1955, the use of loudspeakers will be prohibited from 10.00 pm to 6.00 am. Writing slogans on any public and government property, pasting posters and pamphlets, putting up party flags, putting up banners on public roads, hoardings and installing pylon gates is banned. In case of violation of the ban, action will be taken against the persons concerned under the relevant provisions of the Prevention of Defacement of Property Act, 1987.

Writing slogans, pasting posters, pamphlets, putting up party flags and hoardings on any personal property without the written permission of the property owner is prohibited.  Five or more persons shall not gather at any place for the purpose of committing any offense defined in the Indian Penal Code and for causing breach of the peace. No person, political party, organization and candidate shall use any kind of poster, pamphlet, and photograph which hurts the sentiments of any person, community, religion, caste and thereby violates the model code of conduct.

No person or political party or organization or candidate shall use any such objectionable remarks against any particular person, unlawful message, on WhatsApp, Facebook, Twitter and Instagram or on social media or on any system, which may affect personal, religious and ethnic sentiments of the candidates are hurt and thereby violates the model code of conduct for elections. In case of violation of the above, action will be taken against the concerned under the relevant provisions.

No person, political party, organisation or candidate shall use any religious place for political propaganda and shall not act to incite communal sentiments.

No person, political party, organization or candidate shall do any act of intimidation, intimidation or attempt to induce any voter. No part of the Government owned guest house building shall be used for any political activities or meetings. No act shall be done by any political party or candidate or any other person who may cause hatred between different castes or religious or linguistic communities.
