The National Human Rights Commission (NHRC) has been informed that an amount of Rs 1 lakh has already been paid to a victim of medical negligence whose urinary track was cut while conducting family planning operation in the Dasapalla Community Health Centre.
In compliance of an order of the NHRC acting on the petition filed by activist and Supreme Court lawyer Radhakanta Tripathy, the Odisha Government submitted the report with proof of payment.
Tripathy alleged that a doctor cut the urinary bladder of a woman while performing tubectomy on her at Daspalla CHC in Nayagarh district on July 16, 2019. He requested the NHRC to take action against the errant officials and compensate the victim.
The NHRC found the State is vicariously liable for the act of its doctors and medical staff and recommended a compensation of Rs 1lakh to victim Kalia Barad wife of Rama Chandra Barad, a resident of Ward No. 16 of Daspalla NAC.
The NHRC rejected the contention of the State that all types of pre medical check-up of the patient were done before the operation.
It is pertinent to mention here earlier acting on a petition by Tripathy the NHRC directed the Chief Secretary of Odisha in 2018 to pay a sum of Rs 14 lakh to 56 women, victims of sterilization by use cycle pump in a camp conducted in Angul district in November 2014. However, three victims are not yet traced by the Government and therefore deprived of compensation till date.
