Two weeks after sexual assault, minor boy succumbs to injuries

Nearly two weeks after a 12-year-old boy was allegedly sexually assaulted by three minors, including his cousin, in Northeast Delhi, the police said he succumbed to the injuries at the Lok Nayak hospital on Saturday morning.

Delhi Commission for Women (DCW) chief Swati Maliwal, too, confirmed the boy's death in a tweet. The victim had been unconscious for the last eight days.

Earlier, the Delhi Police apprehended two of the juveniles in connection with the case but they were released by the Juvenile Justice Board after their parents signed an ‘undertaking’. The accused, aged 12 and 13, have been temporarily released on grounds of age and insufficient medical evidence in the case. Maliwal expressed grief and demanded punitive action against the offenders. "This 12-year-old child is no longer with us. The child suffered a lot and fought till his last breath. His killers must be punished severely!," Maliwal wrote on Twitter.

According to Sanjay Kumar Sain, the Deputy Commissioner of Police (DCP), Northeast district, the incident took place on September 18 but the police received the information on September 22 from LNJP Hospital that a boy aged around 10 years has been admitted on account of physical assault that happened three days back.

 "Immediately, a police team reached the hospital and met with the parents of the child, but they refused to give any statement. The family did not give a statement till September 24 while the Investigative Officer, to whom the call was marked, contacted them regularly,” said the DCP. On September 24, a counsellor from “Sakhi” was arranged by the police and counselling of the mother of the injured child was done.

 "After extensive counselling, the mother of the child disclosed that three days back i.e. on September 18 her son was physically assaulted and sodomized by his three friends," the DCP had said.

Accordingly, the police registered an FIR under section 377 (Unnatural offences) and 34 (common intention) of the Indian Penal Code read with section 6 of the POCSO Act and began probing the incident.

During the investigation, it emerged that the victim and the accused boys were friends of the same age category i.e. 10-12 years. "One of the accused was a cousin of the victim child. Also, they are from the same community and residents of New Seelampur Jhuggis," the senior official added.

Of the three accused juveniles, Delhi Police has apprehended two while the third one is still at large. The incident was first brought to light by Maliwal, who said the victim boy's mother submitted to commission that their child was gangraped on September 18 by three boys who even inserted a rod in his private parts. However, the police did not share any such information.
