The Delhi Real Estate Regulatory Authority (D-RERA) directed sub registrars not to register sale deeds for any dwelling unit without the dwelling unit number given by the civic body in the sanctioned building plan.
It has come to the notice of the Authority that various civic authorities like Municipal Corporation of Delhi, Delhi Development Authority, New Delhi Municipal Council and Delhi Cantonment Board are sanctioning building plans with dwelling units having kitchen with additional dwelling units without kitchen built with pantry or store and The builders after sanction of building plans, convert these pantry or store into kitchens and sell units as separate dwelling unit.
Delhi BJP President Virendra Sachdeva on Monday claimed the Delhi government’s notification regarding dwelling units on plots of various sizes has stalled the property registration in the city. He also said the AAP government misused the Supreme Court concern for protecting the interest of property buyers.
The Arvid Kejriwal Government’s RERA notification says that on plots of up to 50 mtrs only 3 Dwelling Units will be allowed that is on plots of 50 mtrs only 3 floors can be constructed or sold while Delhi is full of small plots of upto 50 mtrs have 4 to 5 Dwelling Units, Sachdeva said.
Similarly, the order says that only 4 Dwelling Units will be allowed on plots of 50 to 250 mtrs while Delhi is full of properties of above 100 mtrs up to 250 mtrs with 6 to 8 Dwelling Units, he said.
Sachdeva said it was shocking to note that in a city where a common middle class man opts for a 50 mtrs to 250 mtrs flat, the Kejriwal Government’s RERA notification restricts the accommodation but allows increased FAR and Dwelling Units on rich man plots of above 250 mtrs to 3750 mtrs.
Delhi BJP President said Delhi has 1,671 unauthorised colonies with lacs of units where no building plan is sanctioned till date and so one fails to understand how will property sale purchase happen in these areas.
In unauthorised colonies 3 to 4 houses of say 200 mtrs normally have 8 to 10 Dwelling Units and people want to know from Kejriwal what will the future of their homes as after this RERA Notification these homes become illegal with their sale purchase not possible, Sachdeva said.
Delhi BJP President said entire walled city and parts of East Delhi, West Delhi and South Delhi have commercial and mixed use buildings and Delhi Government RERA Notification, if implemented, will destroy the future of these mixed trade cum residential zones.
Property occupants in areas likes Chandni Chowk, Chawri Bazar Gandhi Nagar, Shahdara, Rajouri Garden, Uttam Nagar, Kamla Nagar, Kotla Mubarakpur, Lajpat Nagar with Mixed Land Use fail to understand how they will sell property in hour of need, he claimed.
Sachdeva said Kejriwal should clarify whether this RERA notification will apply on properties constructed before today 20 November 2023 or hereafter as this notification will not only destroy the property trade in Delhi but also severely effect the interests of individual property owners.
