Encroachment on Army land cleared in Mhow

Mhow defence estate officer and Mhow administration took the possession of the petrol pump and vehicle yard which was constructed on 2.646 hectare of army land which is the part of Hema firing range of army under infantry school Mhow.

The land was grabbed by by Aasma Bee, wife of Mohammad Siddiqui of Banjari in Bhatkehedi village panchayat area with the help of forged and illegal documents.

The High Court bench of Indore comprising of justices SC Sharma and Shailendra Shukla passed an order of removal of encroachment from the defense land and dismissed the appeal and writ petition number 10336/2019 and 19266/2019 of Aasma Bee and Abdul Samad.

The land which was sold by Subratan bee and Hasan to Aasma Bee was already acquired by government of India in the year 1988 for establishing firing range. Subratan Bee also received the compensation for this land from government of India.

The purchaser Aasma Bee on the basis of sale deed of the year 2004 got mutated, diverted and also got permission of T&CP and constructed the petrol pump. High court mentioned the fact very clearly that this case is a glaring example of land fraud which took place in Madhya Pradesh. Systematically, the government land is converted into a private land in connivance with the revenue authorities.

The diversion order was passed mutation has been done and then all kind of hindrances are created to ensure that the government land becomes a personal property. It is a case in which fraud of great magnitude has taken place prime facie and all types of legal jugglery has taken place so any how this government land becomes private land.

The court dismissed the writ petition of Aasma bee and at the same time is of the considered opinion that the matter requires a probe by the Lokaukta to find out whether the officers of the state government were part of large scale of conspiracy in diverting government of India land to private person in spite of the fact that the land was acquired compensation was paid and also probe in respect of various orders which has been passed by various officers from time to time and therefore a request is being made out to the Lokaukta to register a case and to probe the matter and to proceed ahead in accordance with law.

Defence Estate Officer Mhow Neha Gupta told The Pioneer that we have repeatedly given the notice to the Aasma Bee to vacate the land as it belong to army but she denied our appeal. The market value of 2.646 hectare of government land which is freed from the encroachment of petrol pump owner Aasma Bee is around Rs 5 crore.
