The court of Justice Sanjay Dwivedi of Jharkhand High Court on Saturday gave the last opportunity to Jharkhand police to file a supplementary counter affidavit in the case related to the alleged murder of Binay Mahto, a student at the Sapphire International School.

Manbahal Mahto, the father of the deceased, had approached the High Court in 2018 requesting a CBI inquiry of this case. He approached the court after two children booked by police on the murder charge were acquitted from Juvenile Justice Board whereas their parents were released on bail.

The aggrieved father said that the police botched up the investigation and he did not hope his son would get justice.

On the intervening night of February 4 and 5, 2016, Binay Mahto a student of class VII was murdered on the school campus.

Jitendra Singh, the advocate of the petitioner said that the court gave the last opportunity to police to file a counter-affidavit as to why not an investigation should be referred to the CBI. The court will take up this matter on December 2 means by this time the police will have to submit the reply.

“The court has taken a strong exception to the delay in filing of a supplementary counter-affidavit.  The court even intended to summon the DGP in person to seek an explanation for the delay. But state counsel Manoj Kumar requested for the last opportunity,” Singh said.

Singh said that the court also observed that in a serious case like this where a schoolboy was murdered the police filed a charge sheet in a very casual manner to save real culprits and the same has been observed by the trial court in its order.

The deceased was found lying in the pool of blood at the entrance of the teacher’s hostel which is situated about 800m from the boys’ hostel where he was staying.

Police arrested a female teacher of this school along with her husband who was a mathematics teacher at Taurain World School. Besides, their minor son and daughter were arrested. Police presented juvenile love theory as the reason behind the murder.
