Three sentenced to 4-yr jail under Arms Act in Garhwa

The court of Chief Judicial Magistrate, Garhwa Kumar Vipul sentenced four year imprisonment to three accused, on Tuesday. Court also imposed a fine of Rs. 10 thousand to each accused under Arms Act.

The three persons sentenced to  imprisonment were identified as Ravi Tiwari, Atul Dhar Dubey and Anjan alias Ashish Dhar Dubey of Hasker village under Garhwa Police Station.

According to the FIR lodged in Garhwa police station, a police team was on patrol on the morning of 28 June 2023. In the same sequence, a robbery took place near Pachpadwa village and a cordon was laid to catch the robbers. In the same sequence, on the information of the villagers, the police tried to stop a black Scorpio car coming from Korwadih. But on seeing the police, three people sitting in the car started running.

Police ran and caught one of them. While two people were successful in escaping by taking advantage of the forest and bushes. On asking the name and address of the arrested person, he told his name as Ravi Tiwari. During the search, a loaded magazine and a country-made pistol were recovered from his left waist. On removing the magazine, five rounds of live cartridges were recovered from it and 80 notes of Rs 500 were recovered from Ravi's pocket. During the search, another loaded country-made pistol was recovered in a black plastic from the rear seat of the car.

When asked about this, Ravi did not give a satisfactory answer. He told the names of the two people who ran away as Atul Dhar Dubey and Anjan Dhar Dubey. On the basis of his confession statement, those people were also accused and Ravi Tiwari was sent to judicial custody. Later, the other two accused were also arrested and sent to jail. After this, the police conducted an investigation and submitted a charge sheet against these accused  under section 394 IPC. Charges were framed against the accused and the evidence of witnesses was presented in the court by the prosecution.

 The court, after recording the statements of the accused, convicted them on the basis of available documents and evidence and after hearing on the point of punishment, sentenced them to four years of rigorous imprisonment and a fine of Rs 10,000 each under the Arms Act. All three have been sent to judicial custody. Additional Public Prosecutor Shivshankar Ram argued on behalf of the prosecution and advocates GK Sinha alias Ballu Babu, Sachchidanand Dhar Dubey and Saket Pratap Dev argued on behalf of the defense.
