Registration of property through power of attorney scrapped

With the objective of checking the evasion of stamp duty, the Uttar Pradesh government has scrapped the provision of registration of property through power of attorney.

However, the registration of property among the family members/blood relations will continue as earlier.

A bill replacing the ordinance, for the amendment in Indian Stamps (Uttar Pradesh Amendment) Bill, 2024 was passed by the state assembly on Friday.

The ordinance was promulgated in December last year as the state assembly was not in session. The bill was moved by the Finance and Parliamentary Affairs Minister Suresh Khanna.

Congress and Samajwadi Party members opposed the amendment bill and demanded that it be referred to the select committee of the House.

The minister, however, said the amendment was necessary for checking the evasion of stamp duty. He said the provision of exemption for the registration of property by the family members among themselves would continue. He said with the amendment no other category of person could avail the benefit of power of attorney.

Finance Minister Suresh Khanna said that through power of attorney, a person could authorise someone to do his work on his behalf and it was not mandatory to register the affidavit on the basis of the provision provided in the Registration Act, 1908.

He said even after this, there was a tendency among the general public to register it and every year the number of registrations on this basis was increasing. It is known that in the last five years, the number of registrations done on the basis of registered affidavits in the registry offices of the state have totaled 1,0,2486. That is why the state government has decided to validate the blood-related seal to prevent stamp theft. Apart from this, those who register on the power of attorney or mukhtarnama will have to pay the whole stamp duty.

Blood relatives can be registered on a stamp of Rs 5000. Father, mother, husband, son, daughter-in-law, daughter, son-in-law, brother, sister, grandson, and granddaughter will come in blood relatives.
